1. Acceptance of Terms

By accessing or using the CushionFoamz website at cushionfoamz.com, or by placing an order with us, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or services.

2. Products & Custom Orders

All foam cushions sold by CushionFoamz are custom-made to your specifications. Because each product is made to order:

• Orders cannot be cancelled once cutting has begun
• You are responsible for providing accurate measurements
• Slight variations of up to 1/4 inch are within our manufacturing tolerance
• Colors and textures may vary slightly from screen representations

3. Pricing & Payment

Prices are displayed in US dollars and are subject to change without notice. The price shown at checkout is the final price for your order. We accept all major credit and debit cards through our secure payment processor (Stripe).

A minimum order of $15 per cushion applies. Shipping charges (if applicable) are calculated at checkout based on order volume and destination.

4. Shipping Policy

• We ship to the continental United States only
• Free shipping on orders over $199 (standard shipping)
• Orders under $199: shipping calculated at checkout (starting at $8.99)
• Processing time: 2–5 business days to cut and prepare your order
• Standard delivery: 3–7 additional business days after shipping
• Expedited shipping options are available at checkout
• Foam may be vacuum-compressed for shipping; allow 24–48 hours to fully expand after opening

5. Returns & Refund Policy

Our 30-Day Guarantee

We stand behind the quality of our foam. If your cushion does not meet your expectations due to a defect or manufacturing error on our part, we will replace it at no charge within 30 days of delivery.

Custom-Cut Products

Because each cushion is custom-cut to your specifications, we cannot accept returns on correctly made orders. We are unable to resell custom-cut foam. However:

• If we cut your foam incorrectly based on the dimensions you submitted, we will re-cut it for free
• If you provided incorrect measurements, we may offer a discount on a replacement order
• Defective foam (structural issues, wrong material shipped) will be replaced at our expense

6. Accuracy of Measurements

You are solely responsible for providing accurate measurements. CushionFoamz will cut foam to the dimensions you specify. We strongly recommend:

• Measuring twice before submitting your order
• Measuring the actual foam insert (not the cover) if replacing existing foam
• Contacting us if you have any questions about measurements before ordering

7. Intellectual Property

All content on this Site, including text, images, logos, and software, is the property of CushionFoamz and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

8. Limitation of Liability

To the maximum extent permitted by law, CushionFoamz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site or products. Our total liability shall not exceed the amount you paid for the specific order giving rise to the claim.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.

10. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
